These Terms & Conditions ("Terms") govern your use of the website zapkeyz.com ("Website") and the purchase of products offered by EKAM RAGA TECHNOLOGIES PRIVATE LIMITED, a company incorporated under the laws of India, operating under the brand ZAPKEYZ("Company", "we", "us", or "our").

By accessing our Website or placing an order, you ("Customer", "you", or "your") agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase our products.

1. Definitions

  • "Product" refers to the ZAPKEYZ Carnage MK-01 split mechanical keyboard and any related accessories, add-ons (such as wireless modules or elevation kits), or firmware offered for sale on the Website.
  • "Order" refers to a request placed by you through the Website to purchase a Product.
  • "Pre-Order" refers to an Order placed for a Product that is not yet available for immediate shipment.
  • "Delivery Date" refers to the date on which the Product is delivered to you and recorded as delivered by the logistics carrier.

2. Eligibility

You must be at least 13 years of age to place an order on our Website. If you are between 13 and 18 years of age, you represent that you have obtained verifiable consent from your parent or lawful guardian before making a purchase.

By placing an Order, you represent and warrant that:

  • All information you provide is accurate, current, and complete.
  • You have the legal capacity to enter into a binding contract.
  • You are not barred from purchasing products under any applicable law.

3. Order Acceptance & Confirmation

All Orders placed through the Website are subject to acceptance by us. An Order is considered accepted only when:

  1. Your payment has been successfully processed and confirmed by our payment gateway (Razorpay).
  2. You receive an order confirmation email from us at the email address you provided.

We reserve the right to refuse or cancel any Order for reasons including but not limited to: product unavailability, pricing errors, suspected fraud, or information inaccuracies.

4. Pricing & Payment

  • All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
  • Payment must be made in full at the time of Order. We do not offer Cash on Delivery (COD) or instalment/EMI payment options.
  • Accepted payment methods include: UPI, Credit Cards, Debit Cards, and Net Banking — all processed securely through Razorpay.
  • We do not store your payment credentials (card numbers, UPI IDs, or bank details) on our servers. All payment data is handled exclusively by Razorpay in compliance with PCI-DSS standards and RBI regulations.
  • In the event of a payment failure, your Order will not be confirmed. You may retry the payment or contact us at support@zapkeyz.com for assistance.
  • We reserve the right to modify prices at any time without prior notice. Price changes will not affect Orders that have already been confirmed.

5. Cancellation Policy

You may cancel a confirmed Order within 24 hours of placement, provided the Order has not already been dispatched for shipping. To request a cancellation, email us at support@zapkeyz.com with your order details.

  • If the cancellation request is received within the 24-hour window and prior to dispatch, a full refund will be initiated to the original payment method within 7–10 business days.
  • Cancellation requests made after 24 hours of placement or after the Order has been dispatched will not be entertained.
  • We reserve the right to cancel an Order at any stage if we suspect fraud, pricing errors, or any breach of these Terms. In such cases, a full refund will be provided.

6. Shipping & Delivery

  • We currently ship to addresses within India and select international countries. Shipping availability to your location will be confirmed during checkout based on the pincode or address you provide.
  • Domestic shipments are fulfilled via priority courier partners (e.g., BlueDart, Delhivery). International shipments are handled on a case-by-case basis.
  • Estimated delivery timelines are provided at checkout and are indicative only. Actual delivery dates may vary due to logistics, customs clearance (for international orders), or force majeure events.
  • Risk of loss and title for Products passes to you upon delivery of the Product to the shipping carrier.
  • For international shipments, you are solely responsible for any customs duties, import taxes, or additional fees levied by your country. These charges are not included in the Product price.

7. Pre-Order Terms

Some Products may be available for Pre-Order. The following additional terms apply to Pre-Orders:

  • Estimated delivery dates for Pre-Orders are non-binding and are provided as approximations based on manufacturing and logistics timelines.
  • We will make reasonable efforts to keep you informed of any significant changes to the estimated delivery date via the email address provided.
  • If the actual delivery date is significantly delayed beyond the estimated date (more than 30 days), you will have the right to cancel the Pre-Order and receive a full refund.
  • Pre-Order pricing is locked at the time of payment. Subsequent price changes will not affect your Pre-Order.
  • The general 24-hour cancellation policy (Section 5) also applies to Pre-Orders. Beyond that window, Pre-Orders may only be cancelled if the significant delay provision above is triggered.

8. Warranty

All ZAPKEYZ Products are backed by a 1-year limited warranty from the Delivery Date. This warranty covers manufacturing defects including but not limited to:

  • Dead or non-functional key switches
  • Faulty printed circuit board (PCB)
  • Defective or non-functional USB-C port
  • LED / underglow failure
  • Bluetooth / wireless connectivity defects (if applicable)
  • OLED display malfunction

The warranty does NOT cover:

  • Physical damage, drops, or impact damage
  • Liquid spills or water damage
  • Damage caused by flashing custom or third-party firmware (the RP2040 MCU ships with ZAPKEYZ proprietary firmware — modifying it voids the warranty)
  • Unauthorized hardware modifications, disassembly, or soldering (note: the switches are not hot-swappable; attempting to desolder or swap switches will void the warranty)
  • Normal wear and tear, including keycap surface wear
  • Cosmetic imperfections that do not affect the functionality of the Product

To initiate a warranty claim, contact us at support@zapkeyz.com with your order details, a description of the issue, and supporting photos or videos. We may request that you ship the defective unit to us for inspection before processing the claim.

9. Replacement Policy

We offer a 7-day replacement policy from the Delivery Date, strictly for manufacturing defects as described in Section 8.

  • To be eligible, the replacement request must be submitted within 7 calendar days of the Delivery Date.
  • Replacements are provided as a like-for-like exchange of the same Product. We do not offer refunds, store credits, or exchanges for a different product under this policy.
  • The defective unit must be returned to us in its original packaging (or equivalent protective packaging) at our expense. We will arrange a reverse pickup or provide a prepaid shipping label.
  • Upon receiving and inspecting the defective unit, a replacement will be dispatched within 7–10 business days.
  • This policy does not apply to damage caused during transit. If your Product arrives damaged, please report it within 48 hours of delivery with unboxing photos/video, and we will process a replacement immediately.

We do not offer refunds or returns for change of mind, buyer's remorse, or any reason other than a verified manufacturing defect.

10. Intellectual Property

All intellectual property rights in and to the following are owned exclusively by EKAM RAGA TECHNOLOGIES PRIVATE LIMITED and/or its licensors:

  • The ZAPKEYZ brand name, logo, wordmark, and all associated trademarks.
  • The Carnage MK-01 product design, industrial design, and engineering specifications.
  • All proprietary firmware embedded in the RP2040 MCU, including but not limited to the keymap engine, SOS key functionality, layer management system, and LED control software.
  • All website content including text, images, videos, graphics, 3D models, animations, and the overall design and layout of the Website.

You may not copy, reproduce, distribute, modify, reverse-engineer, decompile, or create derivative works of any of the above without our prior written consent. Purchasing a Product does not grant you any license or rights to our intellectual property beyond the right to use the Product for its intended personal purpose.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Our total aggregate liability to you for any claim arising out of or relating to these Terms, the Website, or any Product shall not exceed the purchase price you paid for the specific Product giving rise to the claim.
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill.
  • We shall not be liable for any delays, failures, or interruptions in delivery caused by events beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, strikes, or carrier delays ("Force Majeure").

12. Disclaimer of Warranties

Except for the express limited warranty provided in Section 8, the Products and Website are provided "as is" and "as available" without any warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.

13. User Conduct

By using the Website, you agree not to:

  • Provide false, inaccurate, or misleading information during checkout or account creation.
  • Use the Website for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to any part of the Website, its servers, or any connected systems.
  • Interfere with or disrupt the operation of the Website or the servers or networks connected to it.
  • Scrape, crawl, or use automated means to access the Website without our prior written consent.

14. Privacy

Your use of the Website and any personal data you provide is governed by our Privacy Notice & Policy, which is incorporated into these Terms by reference. By using the Website, you consent to the collection and use of your information as described in the Privacy Policy.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any disputes arising out of or in connection with these Terms, the Website, or any Product shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.

16. Indemnification

You agree to indemnify, defend, and hold harmless EKAM RAGA TECHNOLOGIES PRIVATE LIMITED, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms.
  • Your misuse of the Website or any Product.
  • Any false, inaccurate, or misleading information provided by you.
  • Your violation of any applicable law or the rights of any third party.

17. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and EKAM RAGA TECHNOLOGIES PRIVATE LIMITED regarding your use of the Website and purchase of Products. These Terms supersede all prior agreements, representations, and understandings.

19. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting the updated Terms on the Website with a revised "Last Updated" date. Your continued use of the Website or placement of Orders after such changes constitutes your acceptance of the revised Terms.
